Tencent, China's largest instant messaging service provider, was accused of abusing its dominant market position in the case filed by Qihoo 360, an anti-virus software company.
中国最大的即时通讯服务供应商腾讯公司被杀毒软件公司奇虎360起诉，称其滥用市场支配地位。
Abuse its dominant market position就是“滥用市场支配地位”，更专业的说法为abuse of market ascendancy，即“滥用市场优势地位”，指企业获得一定的市场支配地位以后滥用这种地位，对市场的其他主体进行不公平的交易或排斥竞争对手的行为。其表现形式有：不正当的价格行为(improper pricing)、差别对待(differentiated treatment)、强制交易(forced transaction)、搭售和附加不合理条件(tie-in sale and imposing unreasonable conditions)、掠夺性定价(predatory pricing)、独家交易(exclusive dealing)。
此案是2008年8月1日《反垄断法》(Anti-Monopoly Law)实施以来互联网领域的首个反垄断案例。今年3月28日，360诉腾讯滥用市场支配地位一案一审宣判。广东省高院驳回360全部诉讼请求(rejected all claims by 360)。判决认为，腾讯不存在市场支配地位，也不存在滥用问题。360不服一审判决，于今年4月向最高人民法院提出上诉(appeal to the Supreme People’s Court)。
