Beijing's High People's Court upheld the death penalty Friday for Han Lei, who was convicted in the death of a 2-year-old girl pulled from her stroller.
Han, 39, was sentenced to death for homicide at Beijing No 1 Intermediate People's Court on Sept 25, but he appealed to the higher court. He provided some new evidence on Nov 19, when the higher court heard his case.
Han pulled the girl from her stroller, in what he said he regarded as a handcart, after arguing with her mother over parking in the capital's Daxing district on July 23.
Two days later the girl died of serious head injuries. During the two trials, Han maintained that he did not mean to harm the child, insisting it was his carelessness that caused her death. Han's lawyer did not comment after the verdict announcement.

11月19日，该案在北京市高级人民法院二审开庭。韩磊的辩护人表示，韩磊的行为属法律上的客体认识错误，是对侵犯对象发生的错误认识，本案系过失致人死亡案件，而不是故意杀人案件。一审法院在证明标准上不够确实充分，不能排除韩磊是过失致人死亡的合理怀疑，认定事实不清，证据不足，请求依法改判或发回重审。

今年7月23日20时50分许，在大兴区科技路公交车站，韩磊与李明因停车与一名女子发生争执。过程中，韩磊将婴儿车内的女童摔在地上，导致女童严重受伤后死亡。今年9月25日，北京市一中院以故意杀人罪一审判处韩磊死刑，法院同时裁定准许受害人家属撤回此前对韩磊提出的总计273万余元的附带民事诉讼请求。韩磊随后提出上诉。11月19日，北京市高级人民法院对韩磊上诉案进行了公开审理。
韩磊父亲已有二审维持原判心理准备
韩磊的父亲表示，他已有二审法院维持原判的心理准备，“但我相信法院会做出公正的判决”。他还说：“我们非常想和受害人家里达成和解，想真诚地给受害人赔罪，让自己的良心得到宽恕。”他表示，自己跟老伴已退休多年，没什么积蓄，但如果对方能够接受，愿意把现在的住房卖掉作为赔偿。
